James W. Miskowski, Counsellor at Law, is admitted to practice in the States of New York and New Jersey as well as the U.S. Supreme Court. He has represented private and corporate clients for over 40 years. His primary area of expertise is in Adoption and Assisted Reproduction Technology Law. He has helped build over 2,500 families and is the father of three adopted children.

James has been in the forefront of litigation and advocacy, which has shaped the laws over the past three decades through his legislative efforts and published decisions. His success has lead to nine (9) opinions being published by the Appellate courts including the New Jersey Supreme Court which became established law.

These cases were of first impression in the courts which included one of the first cases in the country regarding the use of social media, particularly Facebook, as a constitutional alternate means to serve process on a party in litigation involving children; Jurisdiction/Conflicts of Law, between States’ and determination of which State’s law will govern the adoption of a child; Women’s’ privacy rights, protecting a woman’s rights not to disclose her sexual partners as a condition to placing a child for adoption ; Unwed birth fathers rights and obligations to establish his parental rights to a child placed for adoption ; Intended parents rights and psychological evaluations to qualify persons as fit parents in surrogacy arrangements ; and amendment of adoption laws to permit Private Independent Adoptions.
